Terms of Service

1. Acceptance of terms

By creating an account on Combatif, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the platform. We reserve the right to update these terms at any time; continued use of the platform after changes constitutes acceptance.

2. Description of service

Combatif is a cycling competition platform that allows users to:

• Create and join cycling competitions in various formats.
• Connect third-party fitness platforms (e.g. Strava) to import activity data.
• Create and join groups for organising competitions within communities.
• View leaderboards and track performance over time.

The service is provided free of charge. We reserve the right to introduce paid tiers or modify the service at any time.

Combatif is a technology platform only. We do not organise, supervise, or endorse any cycling competition, event, or physical activity conducted through the platform. All competitions are created and managed entirely by end users.

3. Account responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Providing accurate registration information and keeping it up to date.
• Notifying us immediately of any unauthorised use of your account.

You must be at least 16 years old to create an account. If you create an account on behalf of minors under 16, you confirm you have the authority and consent of their parent or legal guardian.

4. Acceptable use

You agree not to:

• Submit false, manipulated, or fraudulent activity data to gain an unfair competitive advantage.
• Attempt to gain unauthorised access to other users' accounts or platform systems.
• Use the platform for any unlawful purpose or in violation of any applicable laws or regulations.
• Harass, abuse, or harm other users.
• Attempt to reverse engineer, decompile, or extract source code from the platform.
• Use automated means to access the platform in a manner that could degrade performance for other users.
• Create competitions that involve illegal activities, prizes constituting unlawful gambling, or entry fees that violate applicable laws.

We reserve the right to suspend or terminate accounts that violate these terms.

5. Competition organiser responsibilities

When you create a competition on Combatif, you act as the organiser of that competition. As organiser, you are solely responsible for:

• Legal compliance: Ensuring the competition complies with all applicable local, national, and international laws and regulations, including but not limited to road traffic laws, cycling regulations, permit requirements, insurance obligations, and any rules governing prize competitions or gambling in your jurisdiction.
• Prizes and incentives: If your competition involves prizes, entry fees, or any form of monetary reward, you are solely responsible for ensuring this complies with applicable gambling, prize competition, and consumer protection laws in all jurisdictions from which participants may join. What constitutes lawful prize competition varies significantly by country.
• Participant safety: Ensuring that participants are made aware of any risks, route conditions, and safety requirements relevant to the competition.
• Participant eligibility: Verifying that participants meet any applicable age, licensing, or eligibility requirements for the activities involved.
• Accurate information: Providing truthful and complete competition details to participants.

Combatif provides tools for tracking and displaying competition results only. We are not a co-organiser of any competition and accept no responsibility for how competitions are conducted, whether they comply with applicable laws, or for any outcome arising from participation.

6. Physical activity and safety

Cycling and other physical activities tracked on Combatif carry inherent risks, including serious injury or death. By using the platform and participating in competitions, you acknowledge that:

• You participate in all physical activities entirely at your own risk.
• You are responsible for assessing your own fitness and health before undertaking any activity.
• You should consult a qualified medical professional before starting or increasing your physical activity levels.
• You are responsible for obeying all applicable traffic laws, road rules, and safety regulations during your activities.
• Combatif does not supervise, guide, or monitor any physical activity and accepts no responsibility for injuries, accidents, or incidents arising from activities recorded on the platform.

7. Third-party integrations

When you connect a third-party platform such as Strava, you are bound by that platform's terms of service in addition to ours. We are not responsible for the availability, accuracy, or terms of third-party services. You may disconnect any platform integration at any time from your Profile page.

Activity data imported from Strava is subject to Strava's Terms of Service.

8. Intellectual property

The Combatif platform, including its design, code, and branding, is our intellectual property. Your activity data belongs to you. By using the platform you grant us a limited licence to process and display your data solely for the purpose of providing the service.

9. Disclaimer of warranties

The platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or secure. Competition results are calculated automatically based on data provided by third-party platforms and we do not guarantee their accuracy or completeness.

We make no representations about the suitability of any competition for any particular participant, the safety of any route, or the legality of any competition in any jurisdiction.

10. Limitation of liability

To the fullest extent permitted by applicable law, Combatif and its operators, employees, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages of any kind.
• Loss of data, missed competition results, or errors in leaderboard calculations.
• Any injury, accident, death, loss, or damage arising from participation in any competition or physical activity tracked on the platform.
• Any act or omission of any user, including competition organisers or participants.
• Any competition that fails to comply with applicable laws, or any consequences resulting from such non-compliance.
• Any claim by a third party arising from your use of the platform or your conduct as a competition organiser.

This limitation applies regardless of the legal theory under which the claim is brought. In jurisdictions that do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, our liability is limited to the greatest extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Combatif and its operators, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the platform.
• Any competition you organise through the platform, including any failure to comply with applicable laws.
• Any injury or damage caused to a third party through your activities or competitions.
• Your violation of these Terms of Service.
• Your violation of any third party's rights.

12. Governing law and disputes

These Terms of Service are governed by and construed in accordance with the laws of the European Union and the Kingdom of Norway, without regard to conflict of law principles. Any dispute arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Norway.

If you are a consumer in the European Union, you may also have rights under the mandatory consumer protection laws of your country of residence, which these terms do not override.

13. Account termination

You may delete your account at any time from the Profile page. We may suspend or terminate your account if you violate these terms, with or without notice. Termination does not affect any obligations or liabilities incurred before termination.
